Appeals

It is the trial attorney’s responsibility to file the Notice of Appeal.  However, if you complete a transmittal sheet, obtain the necessary documents, and submit them to ADC within Twenty days of the final order, ADC will file the Notice of Appeal.  If you fail to submit everything that is required within twenty days, you MUST file the Notice of Appeal yourself.  Click here for the transmittal sheet.   

In order for ADC counsel to be appointed to an appeal, the most important document is the In Forma Pauperis Order.  The conflict of interest with the Public Defender’s Office must continue at the appeal stage, and this must be documented in the motion for counsel. If the conflict of interest does not continue, or is unclear, please send the appeal packet to the Public Defender’s Office at [email protected]
