Program Overview
The Municipal Court Program, created within the Office of the Alternate Defense Counsel pursuant to C.R.S. §§ 13-10-114.5(3)(b)(I), 21-2-103(5), and 21-2-108, to ensure that indigent clients charged with a municipal ordinance violation carrying any possibility of incarceration are represented by independent and constitutionally adequate counsel.

Evaluation Services Request Form
As of January 1, 2020, C.R.S §21-2-108(2) requires Municipal Courts to provide independent indigent defense. In order to fulfill that requirement, municipalities must have a nonpartisan entity evaluate court-appointed counsel. Through the Municipal Court Program, the Office of the Alternate Defense Counsel (OADC) may serve as that nonpartisan entity, and the OADC evaluation services under this provision are free to the municipalities.
Any municipality seeking the assistance of the OADC to evaluate the independence and competence of court-appointed counsel for services beginning January 1 must request this assistance by September 1 of each year. Per the timelines in the statute, this request is for services 15 months in the future. Please click here (link to a Formsite form) to complete and submit the application by September 1, 2024, for services beginning January 1, 2026.
If we do not receive this application by September 1, we will be unable to address personnel and funding issues in our annual budget, resulting in the possibility of not being able to provide attorney evaluation services.
